The National and State Assembly Election Petitions Tribunal, based in Enugu State, has nullified the victory of Hon. Okey Mbah, a member of the Peoples Democratic Party (PDP), in the March 18 House of Assembly election for Nkanu East constituency.
The Independent National Electoral Commission (INEC) had initially announced Mbah as the election winner, but the tribunal, in its ruling on Friday, determined that the electoral process did not adhere to the provisions of the 2022 Electoral Act.
Led by Honourable Justice Adie Attoe Onyebueke, the three-member panel issued its judgment in response to a petition filed by the Labour Party candidate, Surv. Okwudiri Nnaji, and declared the election inconclusive. The tribunal specifically called for a rerun of the election in certain polling units within Ugbawka and Owo wards.
The tribunal’s decision was based on the observation that the number of votes recorded in these areas exceeded the number of registered and accredited voters, thereby questioning the legitimacy of INEC’s declaration. Consequently, the tribunal has directed INEC to organize a rerun election in the affected polling units within a timeframe of 90 days.
