The Presidential Election Petitions Tribunal (PEPT), chaired by Justice Haruna Tsammani, has asserted that the Independent National Electoral Commission (INEC) is not mandated to transmit election results electronically. This declaration was made by the five-member tribunal during its ruling in Abuja on Wednesday.
Tsammani emphasized, “There is no provision for the electronic transmission of election results in the Electoral Act 2022.”
Regarding the method of transmitting election results, the tribunal stated that INEC has the discretion to determine the mode it wishes to employ. The court held, “By the provisions of Section 52 and Section 65 of the Electoral Act, INEC is free to specify the manner in which results can be transmitted. INEC cannot be compelled to transmit results electronically.”
